Terms and Conditions
Ian Humes is an employee of Pendragon Consultancy Limited who are an umbrella organisation who provide the services of contractors to Industry. They provide PLI, handle invoicing and PAYE and as my employer protect you from IR35 claims as I am employed by them not you. Before I can commence work Pendragon will need to set up the invoicing process and have a signed contract between themselves and your company. This usually takes about a week to set up. Once the project is completed the contract can go dormant until needed again.
Copyright and credit
- The entire copyright for the pictures is always retained by the photographer throughout the world and he asserts both his moral right to be identified as the author of his work and the right to a credit as “Photographer ianhumes.co.uk” which is asserted in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. On receipt of payment by the Employer, the Client is given unrestricted reproduction rights for the supplied images.

Quotes are provided for all projects and the following information is included with all quotes.
COVID-19
Due to the unprecedented changes caused by the pandemic and the guidelines brought in regarding essential travel during lockdowns, the client will need to provide an instruction on headed paper explaining the need for this journey that can be shown to police officers if the photographer and his assistant are challenged. A charge for PPE is also included for the consumable components used. If we are instructed to return home by police officers or travel disruptions prevent completion of the contract, then the contract will be charged for the parts completed with a minimum charge of two (Band 1) images. The invoice will also include expenses and VAT.
Site & Viewpoint Access.
In the event the project will require access to property not under the control of the client, then it is the client’s responsibility to obtain the necessary approval and clearances required for access to such property. In most cases this is not an issue for PROW, footpaths and viewpoints located on public property. However private property, parks, recreation grounds, royal parks and some boroughs that require permission for commercial photography will need to provide approval for access for the required photography. This may incur further charges for the client.
Travel and Accommodation Costs.
The above quote is supplied in good faith however external costs (travel, parking, hotel etc.) may vary between the time of supplying this quote and the date the images are taken. These changes are beyond my control and will be passed on to the client in the invoice. Significant increases will be discussed with client where possible prior to expenditure.
Security.
As many of the locations that require photography are redevelopment areas they also sometimes suffer from higher crime rates. This increases the risk to the photographer whilst working alone in these areas. It has now become necessary to include a charge for security provision when working in these high crime or deprivation areas. All sites are individually assessed using the https://www.ourwatch.org.uk website and the 2019 English Index of Multiple Deprivation (IMD) map if the reported crime rate within one mile of the site is over a specific value or the site is in one of the most deprived areas then security will be required when working on that project. Photography.
High resolution grain free digital 16 bit images using a variety of lenses from my Equipment List to produce the perspective, views and effects required. Images matched to pre-visualisation views when supplied.
Cancellation Fee.
In the event that the project is cancelled by the client at any time for any reason after the client has accepted the quote and giving an instruction to proceed, a cancellation fee will be payable for work completed and 100% of the expenses incurred up to the time of cancellation.
Adverse Weather.
On rare occasions it may be impossible to capture the images that the client requires on the day that we visit site. This can be because of fog or some other force majeure. In these cases, you will be informed as soon as possible and given the option of paying for what has been completed up to that point (minimum charge of two Band 1 images) or asking us to stay on site and capture what we can, which would incur the full cost as specified in the quote.
Lighting.
Photography is highly dependent upon the weather and prevalent lighting conditions. Every effort will be made to supply the images you require under the current weather conditions. Images of the site will be supplied with as favourable lighting as possible. If specific lighting / sky conditions are required (blue sky in all images) then this should be specified by the client and more time should be allocated to complete the shoot.
